PERFORMANCE TERMS

1. Health & Safety

1.1.- The Performer shall take all reasonable steps to safeguard their own health and safety and that of any other person who may be present or be affected by their actions during the course of a performance.

1.2.- The Performer shall discuss with the venue contact at time of booking what rigging requirements can be fulfilled by the Venue and any special equipment or rigging that will be required to be provided by the Performer. Any rigging provided by the Venue must have undertaken a structural and load analysis, and evidence of this should be provided in advance of the Performance. The Performer is at all times responsible for their own safety and that of any equipment used.

1.3.- The Performer can arrange for rigging to be provided, checked and tested if required. Such costs are to be reimbursed by the Venue Contact.

1.4.- If any rigging or equipment is to be provided by the Venue, the Venue Representative must ensure that all facilities and equipment to be used by the Performer are clean, in good working order, tested and confirmed as safe for use in advance of the Performance. Quality and Safety records and Certificates of Conformance to be available on request at time of booking and date of Performance.

1.5.- The Performer reserves the right to refuse to perform on any rigging or equipment which has not been checked and tested by a qualified rigger prior to the Performance, or which in the opinion of the Performer appears to be unsafe, with no penalty.

1.6.- The Performer reserves the right to check all rigging in advance of the Performance. Any rigging deemed to be unsafe, or unsatisfactory, and which can not be rectified to the satisfaction of the Performer in advance of the Performance shall result in the Performer terminating this agreement with no penalty.

1.7.- The Performer reserves the right to subcontract a replacement artist in the event of ill health or injury of the Performer.

1.8.- Should the Performer not be able to perform due to ill health or injury they will inform the Venue promptly. Failing to provide a replacement artist for the Performance no fee will be payable.

2. Public Liability

2.1.- The Performer holds, and shall maintain, adequate Public Liability Insurance for any and all disciplines to be undertaken during the Performance. The Performer shall provide evidence of such insurance as and when requested.

2.2.- It is recommended that the Venue holds current Public Liability Insurance covering activities being undertaken in the Venue.

3. Booking and Timescales

3.1.- All bookings must account for time to set up, warm up and preparation, performance breaks and de-rigging. This will be discussed at time of booking, and confirmed by the Performer.

3.2.- The Performer understands that times are subject to change, and so will endeavour to meet any reasonable changes at the request of the Venue contact.

3.3.- The Performer will arrive 2 hours before the Performance time or else when agreed at time of booking. Should the performer be late they will notify the Venue contact immediately.

4. Housekeeping

4.1.- The Venue Contact shall provide for the Performer a private, safe and warm space in which to warm up and cool down. Additionally, access to bathroom facilities and drinking water will be required.

4.2.- At time of booking, the Performer will confirm access times and any special requirements from the Venue on the day of the Performance.

5. Filming and Pictures

5.1.- The Performer agrees that filming or pictures may be taken of the Performance for personal use, on the understanding that credit will be given to “Ana Cerrato- Aerial Artist” on any publication or issue.

5.2.- Any images or videos to be used for promotional purposes shall be approved by The Performer in advance of any use or publication. The Performer reserves the right to refuse permission to publish or use this images for any reason.

5.3.- The Performer shall be given access to any images or videos taken for promotional or business purposes, and will have all rights to use for their own promotion or marketing any videos or images taken of the Performance prior agreement with the Venue.

6. Prices policy

6.1.- Net prices of the Performance are based on an indoor venue with rigging facilities. The Performer can arrange for rigging to be provided. Such costs are to be reimbursed by the Venue. Additional full Technical Requirements specification sheet is available on request.

6.2.- Net prices of the Performance don’t include travel expenses. Miles are typically charged as return journey by car from my place of residence in Bristol.

7. Payments and Deposits

7.1.- Payments details are available from the Performer upon Invoice.

7.2.- The Performer holds full responsability for all income tax and national insurance contribution payments.

7.3.- At time of booking a non-refundable deposit of 10% of agreed fee is required.

7.4.- Full payment of remaining fee is required within 30 days of Performance as stated on the Invoice.

7.5.- Interest will be charged on any invoices not paid within 30 days of receipt of invoice at a rate of 5% per annum.

8. Cancellation policy

8.1.- In the case of cancellation by the Venue contact, the Venue Contact shall be liable to reimburse any cost for rigging or specialist equipment purchased for the Performance. Receipts for this will be provided to the Venue Contact.

8.2.- In the case of cancellation due to force majeure, no fee shall be payable. In all other cases, cancellation policy shall be as follows:

8.2.1.- More than 7 calendar days prior to the Performance, no fee shall be payable.

8.2.2.- 1 to 7 calendar days prior to the Performance, a 25% cancellation fee of the agreed fee is payable by the Venue.

8.2.3.- 0 to 24 hours prior to the Performance, a 50% cancellation fee of the agreed fee is payable by the Venue.

8.3.- The Performer reserves the right to cancel any performance due to personal reason, ill health or safety concerns with no penalty. The Performer will endeavour to provide a replacement artist whenever possible prior agreement with the Venue.

8.4.- Should the Performer be unable to attend the Performance for any reason, and failing to provide a replacement artist, no fee shall be payable and no penalty shall incur.

 

FREESTANDING RIG TERMS

1.- The Freestanding Rig is designed to be put up and taken down with a minimum of 3x persons.

2.- Freestanding Rig net prices are based on 1x Performer with up to 2x aerial Performances.

3.- The Client must provide 2x designated persons to assist with the set up and put down of the Freestanding Rig. The Performer will provide clear instructions to the designated persons to assist with the rig. Assistance is only needed very briefly on the last stage of the set up, and also on the initial stage of the take down of the rig. Total assistance time should not exceed 5-10 minutes total.

 

TEACHING TERMS

1. Price policy

1.1.- Net prices for private sessions are based on 1 hour teaching session at an aerial training space within Bristol.

1.2.- Should the Student require additional warm up or cool down time, this will be included within the hour session.

1.3.- The Student may arrive earlier and leave after agreed session times in order to perform warm up and cool down exercises at no extra cost to the Student.

1.4.- Teaching sessions to be paid in full in cash upon completion of session or within 30 days of session via BACs transfer upon receipt of invoice.

1.5.- Students are to pay travel and room hire for sessions outside of Bristol. Miles are typically charged as return journey by car from the Teacher’s place of residence in Bristol.

2. Cancellation and Lateness policy

2.1.- In the case of cancellation by the Student, cancellation policy shall be as follows:

2.1.1.- More than 24 hours cancellation notice, no fee payable.

2.1.2.- 0-24 hours cancellation notice, fee payable in full upon invoice.

2.2- Should the Student be late for their session, the session will still finish at agreed time.

2.3.- The Teacher reserves the right to cancel a teaching session due to personal reasons, ill health or safety concerns with no penalty.
